Universal Terms of Service
These Terms apply to visitors and every OohYeah account. Role-specific agreements apply only when you activate the matching capability.
Last updated: August 28, 2026 · Version: 2026-08-28-draft-1 · Effective: Pending owner approval
1. Operator, acceptance, and eligibility
OohYeah Inc. operates OohYeah at 242 W Main Street, #389, Hendersonville, TN 37075. By visiting, registering, or using OohYeah, you agree to these Terms and the documents incorporated below. You must be legally able to form a contract and provide accurate account information. Contact [email protected] for support or legal notices.
2. Accounts and multiple roles
Keep credentials secure and promptly correct account information. One account may hold several roles, including fan, buyer, artist, seller, music professional, label, studio, manager, or business account. Accepting these Terms does not accept an unrelated role agreement. A Seller Agreement is required before selling, a Music Pro Agreement before publishing services, an Artist Agreement before publishing artist content or artist monetization, and Subscription Terms before starting a recurring plan.
3. OohYeah’s marketplace role
OohYeah provides a platform that helps users discover, list, buy, sell, and offer music-related content, goods, and services. Unless a listing expressly identifies OohYeah as seller, the third-party seller or provider—not OohYeah—is responsible for the listing, fulfillment, delivery, service performance, returns, and applicable taxes. OohYeah is not a shipping carrier, employer, agent, guarantor, merchant of record, or payment processor merely because it hosts a transaction.
4. Content and intellectual property
You keep ownership of content you submit, but grant OohYeah a non-exclusive, worldwide, royalty-free license to host, reproduce, format, display, distribute, and promote it as needed to operate and market the service. You represent that you have all necessary rights. Copyright, trademark, and other complaints are handled under Intellectual Property / DMCA.
5. Listings, orders, payments, and taxes
Listings and purchase requests are subject to availability, price, delivery method, and listing-specific terms. A seller or provider remains responsible for accepting and fulfilling an order. Where offered, PayPal processes payment under PayPal’s terms; PayPal—not OohYeah—determines whether its Purchase Protection, holds, reversals, or dispute procedures apply. Fees, commissions, subscriptions, taxes, shipping, pickup, returns, cancellations, digital access, and service bookings are governed by the applicable listing, role agreement, and marketplace policy.
6. Reviews, communications, and prohibited activity
Use reviews, messages, and communications honestly and lawfully. Do not infringe rights, misrepresent identity or goods, manipulate ratings, evade fees, misuse payment services, transmit harmful code, harass others, or offer prohibited items or services. See the Acceptable Use Policy and Trust & Safety Policy.
7. Moderation, disputes, and termination
OohYeah may investigate reports and remove content or limit access when permitted by these Terms or law. We may facilitate communication but do not decide every user-to-user dispute or guarantee any outcome. Users should preserve messages, receipts, tracking, and other evidence. You may stop using the service at any time; obligations that reasonably survive, including payment, intellectual-property, and dispute obligations, remain in effect.
8. Third parties, privacy, and service limits
Third-party services, including PayPal and social sign-in providers, have their own terms and privacy notices. The Privacy Policy and Cookie Policy explain OohYeah data practices and choices. OohYeah is provided on an “as available” basis to the extent permitted by law. We do not disclaim non-waivable consumer rights or make promises beyond these Terms and the applicable listing.
9. Liability, indemnity, and legal venue
To the extent permitted by law, OohYeah is not liable for indirect, incidental, special, consequential, or punitive damages arising from third-party listings, providers, or user content. You will indemnify OohYeah for claims arising from your unlawful use, content, or breach. Governing law, jurisdiction, any arbitration or court process, and any liability cap require owner and counsel confirmation before this draft becomes effective; nothing here limits rights that cannot lawfully be waived.
10. Policy hierarchy and changes
These Terms incorporate the policies and agreements below. If they conflict, the order is: (1) transaction- or listing-specific terms, (2) the applicable role-specific agreement, (3) the applicable marketplace policy, then (4) these Terms—always subject to non-waivable law. We may update documents prospectively with reasonable notice where required. The current registry, version, and effective status appear on each policy page.
