OohYeah Acceptable Use Policy (AUP)

1. Overview

Welcome to OohYeah — owned and operated by OohYeah Inc., headquartered at 707 18th Ave S #11, Nashville, TN 37203, USA. OohYeah is a music-first ecosystem and commission-free marketplace empowering artists, bands, labels, and industry professionals to create, promote, and sell directly to fans through our apps and web platform.

This Acceptable Use Policy (“AUP”) outlines the standards of conduct expected from all users of the OohYeah Platform, including the OohYeah website, OohYeah Pro App, OohYeah Listener App, Label Services, and Marketing Services. By using any part of OohYeah, you agree to comply with this Policy, our Privacy Policy, and Terms of Service.


2. Scope

This policy applies to all Users — including artists, bands, labels, fans, and third-party collaborators — who access or use OohYeah’s products, apps, or services. Its goal is to preserve a fair, safe, and professional environment for all members of the OohYeah community.


3. User Responsibilities

Users are solely responsible for any content they upload, post, share, or transmit via OohYeah, including but not limited to audio recordings, artwork, videos, photos, text, or social media posts (“User Content”). You agree to ensure that your use of OohYeah complies with all applicable laws, including copyright, trademark, and privacy regulations.


4. Prohibited Conduct

Users are expected to interact in a manner that is courteous, honest, and respectful toward other members and OohYeah staff. The following behaviors are strictly prohibited:

  • Falsifying identity or impersonating other individuals.
  • Creating multiple accounts to circumvent restrictions.
  • Participating in fraudulent or illegal activities.
  • Harassing, threatening, or intimidating other users or OohYeah personnel.
  • Utilizing hate speech or posting content that promotes or glorifies hatred against any protected class (including but not limited to race, religion, gender) or hate groups.
  • Engaging in discriminatory behavior against other users.
  • Using the platform to sell or promote weapons, firearms, ammunition, explosives, tobacco, alcohol, drugs, or any related paraphernalia.
  • Using OohYeah to promote political or extremist causes unrelated to music.
  • Attempting to gain unauthorized access to OohYeah’s systems, user data, or restricted areas of the platform.

5. Prohibited Items and Content

OohYeah’s Marketplace is dedicated exclusively to music and related creative tools. All listings must pertain to musical instruments, gear, merchandise, or professional music services. The following items and content are strictly prohibited:

  • Non-musical items: Consumer electronics (e.g., laptops, phones, televisions) unless part of a complete music recording setup.
  • Illegal, counterfeit, or stolen goods: Including certificates of authenticity sold separately or forged memorabilia.
  • Hateful or offensive merchandise: Items with hate symbols, extremist imagery, or slurs.
  • Products from sanctioned countries or endangered species: Including items containing restricted woods such as Brazilian rosewood.
  • Unauthorized or pirated software: Including non-transferable or unlicensed digital products.
  • Services unrelated to music: Listings for lessons, repairs, or unrelated freelance work are not permitted in the Marketplace section.
  • Alcohol, tobacco, drugs, or paraphernalia: The sale or promotion of these items is strictly prohibited in compliance with PayPal policy and applicable law.
  • Weaponry or violent materials: The sale or display of firearms, knives, explosives, or weapon replicas is forbidden on OohYeah and its connected services.

6. Listing and Transaction Guidelines

Sellers and service providers using the OohYeah Marketplace must follow these rules to maintain transparency and fairness:

  • Authenticity and Accuracy: All items must be genuine, accurately described, and in lawful possession of the seller. OohYeah may request proof of authenticity or ownership.
  • Original Photography: Sellers must upload clear, original images of their actual item. Stock images are permitted only for authorized dealers.
  • Detailed Descriptions: Each listing must specify condition, modifications, and relevant details.
  • On-Platform Transactions: All transactions initiated on OohYeah must be completed on the platform. Moving transactions off-site to avoid PayPal processing or bypass platform protections is prohibited.
  • No Duplicate Listings: Reposting or duplicating listings to gain additional exposure is not allowed.
  • Binding Sales: Once a sale is completed, both buyer and seller are obligated to fulfill the transaction promptly and professionally.


7. Artist-Specific Restrictions

Artists are prohibited from uploading or distributing any cover material without proper mechanical licensing. If requested, artists must provide proof of licensing or ownership for all musical works. Failure to comply may result in content removal, account suspension, and withholding of funds.


8. Label & Marketing Services

Artists and labels using OohYeah’s Label or Marketing Services must provide accurate and lawful materials for promotion. OohYeah reserves the right to reject or remove materials that are misleading, infringing, or violate advertising standards or community guidelines.


9. Google Drive Integration

When connecting your Google Drive to OohYeah, you may upload files for label review, marketing, or profile updates. Only relevant, legal, and licensed materials should be shared. Uploading copyrighted works you do not own or illegal materials through Google Drive is strictly prohibited.


10. OohYeah Trademarks & Branding

All OohYeah trademarks, logos, and branding are the exclusive property of OohYeah Inc. You may not use or reproduce OohYeah brand assets without express written permission. Implying endorsement or partnership with OohYeah without authorization is prohibited.


11. Marketplace Conduct

  • Sellers must honor accurate descriptions and timely fulfillment of sales.
  • Misrepresentation, false advertising, or sale of prohibited items will result in account suspension.
  • Soliciting off-platform payments or circumventing OohYeah’s secure PayPal checkout is prohibited.
  • Users must comply with PayPal’s Acceptable Use Policy.


12. Use of OohYeah Apps & Social Tools

The OohYeah Pro App and social features are intended to promote your music professionally. Do not post spam, explicit material, or deceptive promotional content. Automated or bulk messaging, bot engagement, and fake interactions are not permitted.


13. Security & System Integrity

  • Do not probe or test system vulnerabilities without authorization.
  • Do not disable or bypass security measures.
  • Do not access data or accounts you are not authorized to use.
  • Do not interfere with servers, APIs, or the functionality of the OohYeah Platform.


14. Reporting Violations

To report any policy violations or prohibited items, contact [email protected] or use the in-app reporting tools. Provide details, screenshots, or links when available. Reports of copyright violations should comply with the DMCA and be sent to OohYeah’s designated copyright agent.


15. Enforcement & Monitoring

OohYeah reserves the right to investigate suspected violations and take action at its discretion, which may include:

  • Removing or restricting access to content.
  • Suspending or terminating accounts without prior notice.
  • Reporting illegal activities to appropriate authorities or PayPal.
  • Withholding funds linked to fraudulent or non-compliant activity.


16. Legal Compliance

Users are responsible for compliance with all applicable laws, including those governing copyright, commerce, privacy, and online sales. OohYeah cooperates with law enforcement agencies and payment processors to maintain a safe and compliant platform.


17. Changes to This Policy

OohYeah may revise this AUP periodically to reflect evolving laws, technology, and platform features. The updated version will be posted with a new “Last Updated” date.
